It is there, but he could still be in breach as he has changed the logo_powered_by.gif to a single pixel clear image which he needs to fix or go to the text mode on it.
Admin/Moderator, you may want to send a warning to this user and remove his link until it is fixed.

To all concerned.
I have been contacted by ADMIN and have responded, the image has been corrected.
I am sure ADMIN will understand what happened.
Many thanks for spotting that I had no idea and felt embarrased about it.
Sorry, there was no intentions for any breach's.
