I have severeal domain names that are not actively used (registered for furture use) well, on last Dec 27 two of them expired. I renewed them on Dec 30 which is ok. I was billed, got successful renewal message, and the domain name in my a/c is shown as renewed.
Not until this Feb when I tried to modify the DNS did I discover it's not renewed by the reseller of the registrar. Here's our conversation

2. Am I guaranteed to be the owner of these two domain names when I'm able to renew them? If they are registered by others for any reason, I require you to get them back for me.
3. it's not a mere matter of the domain registration fees. who will be responsible for the period that the web sites using these two domain names cannot be accessed before it's back? Please get it back for me ASAP

[2003-02-27] We did not lose your domain name. If anyone xxxx.com lost your domain name as they are the registrar and we are only a reseller for them. If you have any problems take the issue wup with them. You can also pay them the $200 fee as we will not ever charge our customers this fee.

I went to the live chat support to ask email address of a manager, he said I need to open a ticket. and he could not understand what the John said either.
Well, I opened another ticket, it's the same John there. only refund, problem goes to the registry/registrar.
They are a reseller then I went the registrar, asked me to contact the reseller for this.
and then the domain is in pending delet state that nothing could be done but to wait it to be released to the public.
I've managed to contact the registry (Verisign), the director there said no error was found in their system so it should be the registar. besides they can do nothing in the pending delete state but to wait it to be deleted.
I'm trying to grab the domain name these days once it's released. however, I seem some speculators are using snapnames and other resources on it. It's a hot generic word here and the English equivalent was sold at a confidential (might be high) price.
Any suggestions on this? In the terms they have certian liability limitations and the governing law is of the state of New Jersy. Well, in my country most such terms of theirs are void but I know little about the situation there in the US.
How likely to win such a case if I ever challenge them? and what the cost supposed to be? Yes I know it's better to consult an attorney on it but our ones do not cover cases oversees, so I'd like to here some suggestions first.
Thanks in advance. If a domain name is valuable to you, monitor it often even though your registrar says everything's ok. |
