Hi

I am getting a few posts that I feel are a bit near the mark for liable and wonder if anyone has used and can provide a sample disclaimer suitable for unsolicited posts on a forum.

Just remove them, if it is your forum, you do not need a reason, if you feel they are near to the mark, then just remove.

You can't disclaim liability for posts made on a forum which is in your control, well not in the UK any way

Doug, thanks - I am in the process of searching for "forums and disclaimers" to gather some info.

HuwR, there is a bit more too it than just deleting the posts because it is my board. What about being away for a few days, or even on holiday for 2 weeks. I am sure there was a ruling with UK ISPs (with newsgroups) about this and they were found to NOT be liable. A forum is unfortunately NOT in your control if you can't be there 24 hours per day.

Suppose somone posted something that crossed the line on this forum, It may be monitored regularly but you may not catch it straight away especially if it was burried in loads of rambing text and a moderator read the first part of the post and wasn't interested in the initial comments of it. What constitutes a reasonable amount of time to remove it?

Is it too late if it has upset someone and the post was there for 24 hours and many people read it. A newspaper is only "active" for 24 hours and they get sued. A really busy forum could reach many people in that amount of time - if it was a hot topic the offending address could find itself in many emails in a very short time. Magazines will often have disclaimers to dissociate themselves with that of authors of individual articles or oublished letters - why not on a forum?
